1. Acceptance of Terms

By accessing or using PhotoStudioGen (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

PhotoStudioGen provides AI-powered image generation services, including but not limited to photo enhancement, portrait generation, background removal, face swapping, and other image manipulation features. The Service operates on a credit-based system where users purchase credits to generate images.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. Credits and Payments

4.1 Credit System

Our Service uses a credit-based system. Each image generation costs a certain number of credits depending on the model and features used. Credit costs are displayed before each generation.

4.2 Purchasing Credits

Credits can be purchased through our website. All prices are displayed in USD. Payment processing is handled by Stripe, and you agree to Stripe's terms of service when making a purchase.

4.3 Credit Expiration

Purchased credits do not expire and remain in your account until used.

5. Refund Policy

All sales are final. We do not offer refunds for purchased credits.

Due to the nature of our digital service and the immediate consumption of AI computing resources upon credit purchase and use, we are unable to offer refunds. Before purchasing, we encourage you to:

  • Use your free credits to test the Service
  • Review the credit costs for different features
  • Ensure our Service meets your needs

Exceptions: We may, at our sole discretion, consider refund requests in cases of:

  • Duplicate charges due to technical errors
  • Unauthorized transactions (with proper documentation)
  • Service outages that prevent credit usage for extended periods

6. Acceptable Use

You agree not to use the Service to:

  • Generate illegal, harmful, or offensive content
  • Create non-consensual intimate imagery or deepfakes
  • Infringe on intellectual property rights of others
  • Generate content depicting minors in inappropriate contexts
  • Create content that promotes violence, hatred, or discrimination
  • Impersonate others without consent
  • Violate any applicable laws or regulations
  • Attempt to bypass content filters or safety measures
  • Use automated systems to abuse the Service

Violation of these policies may result in immediate account termination without refund.

7. Intellectual Property

7.1 Your Content

You retain ownership of images you upload. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service.

7.2 Generated Content

Subject to these Terms and applicable law, you own the images generated through your use of the Service. You may use generated images for personal and commercial purposes.

7.3 Our Service

The Service, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED IMAGES WILL MEET YOUR EXPECTATIONS. AI-GENERATED CONTENT MAY CONTAIN INACCURACIES OR UNEXPECTED RESULTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will cease immediately. Unused credits are non-refundable upon termination.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
