Terms of Service and Privacy Policy

Everything that governs your use of PhotoStudioGen, on one page. The same documents are also available on their own as the Terms of Service and Privacy Policy, and the details of our money-back guarantee are in the Refund Policy.

Terms of Service

1. The agreement

These Terms of Service (“Terms”) are a binding agreement between you and PhotoStudioGen (“we,” “us”) covering the website, web app, API, and every tool we offer (together, the “Service”). By creating an account, buying credits, or using the Service in any way, you accept these Terms, our Privacy Policy, our Acceptable Use Policy, and our Refund Policy. If you do not agree, do not use the Service.

We have tried to write these Terms in plain language. Where a section is in capitals, that is because the law expects it to be conspicuous, not because it matters more than the rest.

2. Who can use the Service

You must be at least 18 years old, or the age of majority where you live if that is higher. We ask for your year of birth and restrict the Service accordingly. If we learn that an account belongs to someone under 18, we close it and delete its content without refund.

  • One person, one account. Accounts are personal and may not be shared, sold, or transferred.
  • Introductory offers, starter packs, and referral rewards are limited to one per person. Creating extra accounts to claim them again is not allowed.
  • You are responsible for everything that happens under your account, including activity through your API keys. Keep your sign-in and keys secure and tell us straight away if you think they have been compromised.
  • You may not use the Service if you are barred from doing so by law, or if we have previously banned you.

3. What the Service does

PhotoStudioGen turns photos you upload into new AI-generated images and short videos: virtual try-on, pose transfer, multiple angles, headshots, creator sets, image-to-video, upscaling, and related tools. Generation is performed by third-party AI models (see Section 10), so results vary, can contain mistakes or artifacts, and are never guaranteed to match what you had in mind.

We add, change, and retire tools and models over time. We will not remove a tool you have already paid to use without either replacing it or letting you spend your credits elsewhere in the Service.

5. Adult content

Some tools can produce swimwear, lingerie, and other mature content. This is permitted only when every person depicted is an adult who has consented under Section 4, which in practice usually means yourself. Regardless of consent, you may never use the Service to:

  • Create any sexual, suggestive, or nude content involving a minor, or anyone who appears to be a minor. We report this to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement
  • “Undress” a person or digitally remove their clothing without their written consent
  • Create non-consensual intimate imagery of anyone, or intimate imagery of a real person who has not agreed to it
  • Publish or distribute adult content where doing so is illegal, or on platforms whose rules you would be breaking

Where the law requires AI-generated or manipulated media to be labelled (for example under the EU AI Act), labelling what you publish is your responsibility.

6. What you may not do

In addition to Sections 4 and 5, you agree not to use the Service, or help anyone else use it, to:

  • Impersonate a real person, or create content intended to deceive people into believing it is real
  • Run scams, fraud, or phishing, or fabricate identity documents, verification selfies, or other material to get into accounts or pass identity checks
  • Create political campaign material, electoral disinformation, or false depictions of real events
  • Harass, threaten, defame, or bully anyone, or promote violence, terrorism, self-harm, or hatred against people based on a protected characteristic
  • Infringe anyone's copyright, trademark, or other rights
  • Break any law that applies to you or to the content you create

You also agree not to misuse the Service itself, including by:

  • Trying to bypass content filters, moderation, rate limits, age checks, or payment
  • Scraping or bulk-downloading the Service, or accessing it by automated means other than our API
  • Reverse engineering, overloading, probing, or interfering with the Service or our providers' systems
  • Reselling access to the Service or your account without our written permission

7. Safety and enforcement

We do not review every generation before you see it. Our AI providers run their own automated safety filters, and we may review uploads, prompts, and outputs when they are flagged by automated systems, reported to us, or needed to investigate abuse, a billing issue, or a support request.

If we believe you have broken these Terms, we may remove content, block a request, suspend or close your account, and, where the law requires or where someone may be harmed, report the activity to the authorities and preserve the relevant data for them. Serious violations, including anything involving minors or non-consensual imagery, lead to a permanent ban without refund.

8. Credits, subscriptions, and payment

8.1 Credits

Most actions cost credits. The price is shown before you start a generation and depends on the tool, quality, length, and resolution you choose. Credits you buy do not expire. Credits have no cash value, cannot be transferred between accounts, and are not refundable except as described in Section 9.

8.2 Subscriptions

Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from the billing page in your account settings. Cancelling stops the next renewal; you keep access until the end of the period you have already paid for. If we change a subscription price, the new price applies from your next renewal, and we will tell you before it does.

8.3 Payment and taxes

Payments are processed by Stripe, and prices are shown in US dollars. Prices may exclude taxes, which are added at checkout where applicable. If a payment fails or is reversed, we may pause your account until it is resolved. Please contact us before opening a chargeback; we will usually sort it out faster.

8.4 Referrals and promotional credits

Credits from referrals, promotions, or support goodwill are a courtesy. We may set conditions on them, and we may withdraw them if they were obtained through self-referral, multiple accounts, or other abuse.

9. Refunds

7-day money-back guarantee. If your first purchase (a credit pack or first subscription payment) is not for you, email us within 7 days and we will refund it in full, provided you have used less than 10% of the credits it included. The full rules are in our Refund Policy.

Automatic credit refunds. If we charge credits but never start a generation, or a generation finishes but we fail to save it, the credits come back automatically. If a provider's safety filter blocks a request, we keep a small flat fee to cover the provider's cost and return the rest; accounts restricted to safe-for-work content are charged in full for blocked requests. Other failed attempts are billed by our providers and are not refunded.

Consumers in the EU, UK, and similar jurisdictions. Credits are digital content supplied immediately. By buying them you ask us to start supplying them right away, and you acknowledge that you lose the statutory 14-day right of withdrawal once you start using them. The 7-day guarantee above still applies, and nothing in these Terms limits rights you have under consumer law that cannot be waived.

10. Third-party providers

We rely on outside companies to run the Service, including AI model providers that render your images and videos, storage and hosting providers, and Stripe for payments. Your requests and files are processed by them on our behalf, as described in the Privacy Policy.

These providers may refuse, filter, or fail a request, and their outages can affect the Service. We choose providers carefully and may change them at any time, but we do not control their systems and are not responsible for their decisions.

11. Who owns what

11.1 Your uploads and results

You keep ownership of the photos you upload. As between you and us, you own the images and videos you generate, and you may use them for personal or commercial purposes, as long as that use follows these Terms and the law. Copyright protection for AI-generated material differs by country and may not exist at all in some; we cannot guarantee that anyone can register or enforce rights in it. Outputs can also resemble existing works, logos, or people by chance, so check before you use something commercially.

11.2 What you let us do

You give us a limited, non-exclusive, worldwide licence to host, process, transmit, and display your uploads, prompts, and results, and to pass them to our providers, only as needed to run the Service for you, keep it safe, and comply with the law. This licence ends when you delete the content or your account, except for records we must keep (see the Privacy Policy). We do not use your photos or results to train AI models, and we do not use them in our marketing without your separate permission.

11.3 Share links

If you create a share link, anyone who has the link can view that item until you remove it. Only share content you are entitled to share.

11.4 Our Service

The Service itself, including its software, design, presets, prompts, demo content, and the PhotoStudioGen name and logo, belongs to us or our licensors. You may not copy or reuse it without our written permission.

12. API access

If you use an API key, everything in these Terms applies to requests made with it. Treat keys like passwords: you pay for every request made with your key. We may set rate limits and may revoke keys that are abused, leaked, or used to resell the Service.

14. Closing an account

You can delete your account at any time from your account settings. This permanently deletes your files and any unused credits, so use your credits first.

We may suspend or close an account that breaks these Terms, puts other people at risk, or exposes us to legal liability. Credits on an account closed for a violation are forfeited. If we close an account for any other reason, or shut the Service down, we will refund unused purchased credits.

Sections that by their nature should continue after an account is closed, including 11, 15, 16, 17, and 18, continue to apply.

15. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE, LIKE YOU, SUITABLE FOR A PARTICULAR USE, OR FREE OF ARTIFACTS. YOU ARE RESPONSIBLE FOR HOW YOU USE WHAT YOU CREATE.

16. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM THE SERVICE, CONTENT YOU CREATE, OR THE ACTS OF THIRD PARTIES, INCLUDING OUR PROVIDERS.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) US$100.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence, and nothing removes rights you have as a consumer that the law does not let us exclude.

17. Indemnity

You agree to cover our losses, liabilities, and reasonable legal costs arising from claims by others about content you upload, generate, or distribute, your breach of these Terms, or your violation of the law or anyone's rights. We will tell you about any such claim and may take control of the defence, and you agree to cooperate with us.

18. Disputes and governing law

If something goes wrong, email us first at support@photostudiogen.com. Most problems are solved that way, and we ask that you give us 30 days to try before starting formal proceedings.

These Terms are governed by the laws of the jurisdiction in which we are established, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts.

19. Changes to these Terms

We may update these Terms. The date at the top always shows the latest version. For material changes we will give at least 14 days' notice by email or in the app before they take effect, except for changes required by law, which may take effect immediately. Changes never apply to purchases made before they take effect. If you keep using the Service after a change takes effect, you accept the new Terms; if you do not agree, you can close your account.

20. General

  • These Terms, the Privacy Policy, the Acceptable Use Policy, and the Refund Policy are the entire agreement between you and us about the Service.
  • If any part of these Terms is found unenforceable, the rest stays in effect and that part is applied as closely to its intent as the law allows.
  • If we do not enforce a right straight away, we have not given it up.
  • You may not transfer these Terms to anyone else. We may transfer them as part of a merger, acquisition, or sale of the business, and will tell you if we do.
  • We are not responsible for delays or failures caused by events outside our reasonable control, including provider outages.

Privacy Policy

1. The short version

  • We collect what we need to run the Service: your account details, the photos and prompts you give us, what you generate, and basic usage data.
  • Your photos go to the AI providers that do the generating, and nowhere else. We do not sell your data, we do not use it for advertising, and we do not use your photos to train AI models.
  • You can delete any image, or your whole account, at any time from the app.
  • The rights described in Section 9 apply to every user, wherever you live.

2. What we collect

2.1 Information you give us

  • Account details: email address, name, and, if you sign in with Google, your profile picture
  • Your year of birth, which we use to confirm you are an adult and to set what content your account can access
  • Content: photos you upload, prompts, settings, saved prompts, presets you create, and the images and videos you generate
  • Anything you send us through support, feedback, or email

2.2 Information created when you use the Service

  • Usage records: which tools you used, when, and how many credits each generation cost
  • Purchase history and your Stripe customer reference (not your card number)
  • Device and log data: IP address, browser, device type, pages visited, referring site, and error reports
  • Referral records, if you were referred or you refer someone

2.3 Cookies

We use essential cookies to keep you signed in and remember your settings, and analytics cookies to understand how the site is used. We do not use advertising cookies. You can clear or block cookies in your browser, although signing in needs the essential ones.

3. How we use it

  • To run the Service: generate your images and videos, store them in your library, and bill you correctly
  • To keep the Service safe: enforce age limits, detect fraud, multiple accounts, and abuse, and investigate content that breaks our Terms
  • To support you and to tell you about your account, purchases, and important changes
  • To improve the product, using aggregated usage and error data
  • To send occasional product news and offers about PhotoStudioGen. Every one of these emails has an unsubscribe link, and unsubscribing does not affect your account
  • To meet legal obligations, such as tax records and responding to lawful requests

We never use your photos, prompts, or results to train AI models, and we never use them in our marketing without asking you first.

4. How your photos are processed

When you generate something, the photos and prompt for that request are sent to the AI provider that renders it, and the result is stored in your library. Providers process your content only to deliver the result and apply their own safety filters.

With incognito generations, the result is not saved to your library and its link expires after about 24 hours. We still keep the usage record needed for billing and abuse prevention.

People at PhotoStudioGen do not browse user libraries. Authorised staff may look at specific uploads, prompts, or results only when needed to investigate a report, a safety flag, a billing dispute, or a support request you have made.

5. Who we share it with

We share personal data only with the service providers that run the Service for us:

  • AI generation providersReceive the reference photos and prompt for each request in order to render your images and videos, and to run safety checks.
  • Storage and hosting providersStore your account, your uploaded files, and your generated results.
  • StripeProcesses payments and holds your card details; we never see your full card number. Privacy policy
  • Email providerSends account, receipt, and product emails.
  • Analytics and error-monitoring providerHelps us understand how the Service is used and fix bugs.
  • Security providerProtects public tools from bots and abuse.
  • GoogleSign-in, if you choose Sign in with Google. Privacy policy

Every provider may use your data only to provide its service to us. If you need the current list of providers, for example for a business compliance review, email privacy@photostudiogen.com.

Beyond those providers, we disclose data only:

  • When the law requires it, such as a valid court order or subpoena, and we will tell you unless we are legally prevented from doing so
  • To report suspected child sexual abuse material to NCMEC and law enforcement, or where we believe in good faith that it is needed to prevent harm to someone
  • If the business is merged, acquired, or sold, in which case this policy continues to apply to your data

We do not sell or rent personal data, and we do not share it for cross-context behavioural advertising.

6. How long we keep it

  • Uploads and results stay in your library until you delete them or your account.
  • Deleting your account from Settings permanently deletes your uploaded and generated files and your account.
  • After deletion we keep a minimal record of your email address, the prompts and tools used, and credits charged. We keep it to handle billing disputes, prevent banned users from returning, and meet legal obligations, and we do not use it for anything else.
  • Payment and tax records are kept by us and Stripe for as long as the law requires.
  • Residual copies in backups may persist for a limited time before they are overwritten.
  • If content is part of a legal hold or an investigation, we keep it for as long as that requires.

7. Security

Traffic to the Service is encrypted in transit, access to production data is limited to the people who need it, and incognito result links are stored encrypted. No system is perfectly secure, but if a breach affects your personal data we will notify you and the relevant authorities as the law requires.

8. International transfers

Our providers operate in several countries, including the United States, so your data may be processed outside the country where you live. Where the law requires, these transfers rely on safeguards offered by our providers, such as the European Commission's Standard Contractual Clauses.

9. Your rights

Whatever country you live in, you can ask us to:

  • Tell you what personal data we hold about you and give you a copy in a portable format
  • Correct data that is wrong
  • Delete your data. You can delete content and your account yourself, or ask us to
  • Stop or restrict certain processing, including marketing emails, which you can also stop with one click
  • Withdraw consent you have given, without affecting processing that already happened

Email privacy@photostudiogen.com from the address on your account so we can verify it is you. We reply within 30 days and never treat you differently for using these rights. You can also use an authorised agent, who will need to show your permission.

EEA, UK, and Swiss users

We process your data to perform our contract with you (running your account and generations), for our legitimate interests (security, fraud prevention, product analytics, and telling existing customers about the Service), to meet legal obligations, and with your consent where we ask for it. You can object to processing based on legitimate interests at any time. You have the right to complain to your local data protection authority, though we would appreciate the chance to help first.

California users

Under the CCPA you have the rights to know, delete, correct, and opt out. We have not sold or shared personal information, as those terms are defined in the CCPA, in the past 12 months.

10. Minors

PhotoStudioGen is for adults only. We do not knowingly collect data from anyone under 18, and we close any account we find that belongs to a minor and delete its content.

Content that depicts a minor in a sexual, suggestive, or exploitative way is removed, the account is permanently banned, and the incident is reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement. We preserve the related data as the law requires for that report.

11. Changes to this policy

If we change this policy, we will update the date at the top. If a change materially affects how we use your data, we will tell you by email or in the app before it takes effect.
